Extended producer responsibility (EPR) for packaging in Latvia

In Latvia, starting from 2022, taxable enterprises generating 300 kg or more of packaging waste in a calendar year are obligated to engage in the expanded producer accountability initiative. This mandate applies across all distribution channels, encompassing not only items marketed through the Marketplace.

What the program includes

The EPR packaging Latvia program covers:
  • All packaging types: primary, secondary, and tertiary
  • All packaging materials: plastic, paper/cardboard, glass, metal, wood, and composite
  • Reusable and single-use packaging
  • B2C and B2B packaging

Thresholds

The benchmark for enrollment in EPR is 300 kg per calendar year. However, as outlined in Latvia’s Natural Resources Tax Legislation, when a merchant initiates a commercial endeavor, they must incorporate packaging in the roster of objects subject to natural resources taxation.

EPR registration procedure in Latvia

The EPR registration Latvia (Packaging) process typically includes:
  • Register as a packaging producer with the State Environmental Service (VVD) through the Packaging Register
  • Sign a contract with a PRO such as: Zaļā josta, Latvijas Zaļais punkts, Zaļais centrs
  • Declare packaging quantities and materials monthly or quarterly
  • Pay eco-contributions based on material types and weights
  • Submit annual reports summarizing the previous year's activities

Authorized representative

In Latvia there is no requirement to appoint an authorized representative. The foreign packaging supplier can perform its duties independently.

Reporting deadline

  • Monthly/Quarterly declarations: based on PRO contract
  • Annual summary reports: typically due by February 1 for the preceding calendar year
  • Penalties may apply for late submission or under-reporting

Who assumes responsibility?

Responsibility under EPR packaging in Latvia is shared among:
  • Producers/importers: ultimate legal and financial responsibility
  • Authorized Representatives: for foreign companies
  • PROs: operational compliance and achievement of recycling targets
  • Retailers: must verify their suppliers’ EPR status
  • Regulatory bodies (VVD, VARAM): enforcement and oversight

Duties of each group

  • Producers: register, contract PROs, report data, and finance recycling
  • PROs: collect, process, and validate data, coordinate recycling
  • Retailers: ensure upstream compliance
