Producer Responsibility Extension for packaging in Hungary

As of July 1, 2023, fresh rules regarding the Extended Producer Responsibility Scheme (EPR) have been implemented in Hungary. The “Extended Producer Responsibility Scheme (EPR) will impact foreign online retail platforms vending commodities to Hungarian customers.

Who is obliged to enroll

Merchants introducing products produced overseas to the Hungarian market for the initial time are bound by compulsory EPR compliance registration. In other words, these are importers providing goods and wrapping to Hungary.

Threshold

No specific benchmarks exist for enrolling in EPR according to Hungarian legislation. Every shipment of products containing packaging necessitates adherence to specific regulations; otherwise, strict penalties will be enforced, resulting in a cessation of commerce.

Fundamental Regulations (EPR) for Hungarian manufacturers

Adherence to the EPR regulation in Hungary encompasses the subsequent procedures:

  • Enrollment with the National Waste Management Directorate of the National Inspectorate for Environment and Nature (NWMD);
  • Execution of an accord with the designated entity MOHU MOL Hulladékgazdálkodási Zrt. (referred to as MOHU);
  • Formulation and submission of regular reports to MOHU;
  • Settlement for the quantity and dimensions of your refuse.

Authorized Representative

Parties desiring to enlist in the EPR compliance framework are not compelled to designate a representative but retain the option to do so at their discretion.

Reporting Deadline

Businesses must maintain records of their packaging and furnish their reports on a quarterly basis. The due date is the 20th of the month succeeding the reporting duration. The initial declaration must be filed by October 20, 2023.
As of July 1, 2023, Hungary has introduced a new regulation for textile products, making manufacturers responsible for the waste management, collection, and preparation for reuse of textiles sold within Hungary. This change aligns with the European Union's sustainability goals and Hungary's commitment to meeting EU recycling targets.

What the Textile Includes

Under the Hungarian EPR, the following textile categories are included:

  • Clothing items like shirts, trousers, and accessories
  • Household textiles such as bedding (duvet covers, sheets), towels, and kitchen linens
  • Footwear and similar items intended for personal use

Who Must Register

The Hungarian EPR applies broadly to companies involved in the initial sale or distribution of textiles, including:

  • Domestic manufacturers placing textile products on the Hungarian market
  • Importers of textile products
  • Hungarian and foreign online retailers selling textiles to Hungarian customers
  • Businesses producing finished textile goods
*Entities such as raw material suppliers and second-hand sellers are exempt from these requirements as their goods have already been circulated.

Threshold

The Hungarian EPR regulation specifies no minimum threshold. All companies placing textiles on the Hungarian market must comply and register to meet the new obligations.

Registration Procedure

To comply with the EPR regulations in Hungary, companies must follow these steps:

  1. Register on the Hungarian Partner Portal as a producer to initiate EPR compliance.
  2. Register in the Hungarian system, managed by the National Waste Management Authority, to fulfill record-keeping and reporting requirements.
  3. Sign an EPR compliance agreement if you opt for collective compliance.
  4. Maintain detailed records of the types, quantities, and codes for all textile products placed on the market.
  5. Submit quarterly reports on sales and pay the corresponding EPR fees based on tariffs set by the Energy and Public Utility Regulatory Authority.

Authorized Representative

Foreign manufacturers without a registered presence in Hungary are required to appoint an authorized Hungarian representative to handle compliance on their behalf. This representative must be registered in Hungary and will be responsible for meeting all EPR obligations, including reporting and fee submission, as specified by the EPR framework.

Reporting Deadline

Companies and representatives must submit quarterly reports, with each submission due by the 20th day following the quarter-end. Additionally, an annual report on the total quantity of products placed on the Hungarian market must be submitted each year.
