Extended producer responsibility (EPR) for packaging in Romania
Romania implements EPR packaging Romania under Law 249/2015 on packaging and packaging waste, together with subsequent amendments and implementing ordinances. Under this regime, producers, importers and distributors carry responsibility for taking back, recycling, and disposing of packaging waste they place on the Romanian market. The EPR scheme covers major material streams: paper and cardboard, glass, plastics (including PET), metals (steel, aluminium) and wood. Romania’s system uses Packaging Recovery Organisations (PROs) to fulfil collective obligations on behalf of producers.Who must register for EPR in Romania
- Any economic operator (manufacturer, importer, distributor) placing packaged goods (or packaging itself) on the Romanian market must comply
- Entities from outside Romania must appoint a Romanian tax or legal representative or local branch, and that representative assumes EPR registration responsibilities
- Those placing only industrial / non-household packaging are also subject, though in some cases they may contract directly with PROs
- If a large marketplace acts as deemed supplier under Romanian rules, obligations may differ; still, your own sales outside that scheme require your own EPR registration Romania
What the package includes
- Primary, secondary, and tertiary packaging used in products, transport packaging, protective packaging - irrespective of material
- All materials: plastic, paper/cardboard, glass, metal (steel, aluminium), wood
- Reusable or refillable packaging also falls under responsibilities, especially if end-of-life recycling or take-back is involved
- Note: labeling obligations must be met: alphanumeric codes, material code and “triangle arrows” must be visible, legible, durable
Threshold
Romania, there is no minimum threshold (de minimis tonnage) below which companies are exempt from EPR packaging obligations. All producers, importers, and distance sellers introducing packaging onto the Romanian market are required to comply, regardless of the volume placed on the market.Some Producer Responsibility Organizations (OIREPs / PROs) may allow simplified reporting for very small quantities, but legally, no exemptions are provided for small producers.EPR registration procedure in Romania
- Register with AFM in the National Register of Producers under the Environmental Fund Administration
- Submit baseline data: volumes of packaging placed on the market (by material), types, and anticipated future volumes
- Choose whether to comply individually or via a PRO / Integrated Management System (SIG) (e.g. Eco-Rom Ambalaje)
- Sign contract with selected PRO, which will manage collective collection, recycling, reporting
- For non-EU operators, appoint local representative and submit appropriate documentation
- Receive certification / registration number from AFM or environmental authority confirming your EPR registration Romania status
Authorized representative
Non-Romanian or foreign companies must appoint a Romanian representative (tax agent, legal entity) to act on their behalf. This representative has legal accountability for reporting, payments, data submission. The representative is often the entity that signs the contract with the PRO and interacts with Administrația Fondului pentru Mediu (AFM).Reporting deadline
- Monthly or quarterly: Report the quantities of packaging introduced (by material) and the recovery achieved via PRO
- Annual statement: by February each year, summarise the past year’s data and forecast for the coming year
- Late or incorrect reporting triggers financial contributions / penalties paid to the Environmental Fund
Who assumes responsibility?
- The economic operator placing packaging on the Romanian market bears the responsibility, unless transferred via PRO
- The PRO handles the logistics, collection, recycling, auditing obligations at scale
- The AFM and national environmental authorities monitor compliance, impose fines, audit PROs and operators
Duties of each group
Economic operator (producer/importer/distributor):- Enter into PRO contracts or establish an individual system

- Pay contributions / fees per kg to PRO or Environmental Fund
- Ensure labeling and traceability
- Retain records and auditing data
- Aggregate obligations of members
- Operate or outsource collection, sorting, recycling

- Enforce compliance, impose contributions & fines
- Validate audit, verify reports
